Vicor Corp. (Andover, MA) announced that it has entered into a settlement with Unitrode Corp. (Merrimack, NH) under which the parties have agreed to withdraw their respective appeals of the jury verdict handed down on May 25, 2001, in Federal District Court, Boston, in a patent infringement suit brought by Vicor with respect to its "reset patent" (US Patent 36,098).
In that proceeding, the jury upheld the validity of Vicor's reset patent, which the Court had earlier found to have been infringed by Unitrode and a number of Unitrode customers using certain Unitrode chips. However, the jury also found that Unitrode had not induced its customers to infringe.
On September 4, 2001, Unitrode filed a notice of appeal in the US Court of Appeals for the Federal Circuit seeking to overturn the jury verdict of patent validity. Vicor opposed Unitrode's appeal and filed a cross-appeal seeking to overturn the jury verdict of non-inducement. The parties have now agreed to withdraw their appeals and dismiss their respective claims. Vicor retains the right to recover damages directly from infringers using Unitrode chips.
